Terms of Service

These Terms of Service ("Terms") are the rules for using NeedToFind (the "Service"). The Service is run by Gray Penguin Development ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. Who can use NeedToFind

You must be at least 18 years old and able to enter into a binding agreement. You must follow all laws that apply to you and to what you post.

2. What the Service is, and isn't

NeedToFind is an online venue where people post "wanted ads" describing something they're looking for, and other people can respond. That's all it is. We don't buy, sell, hold, inspect, ship, or guarantee any item. We don't process payments. We don't verify who members are or whether what they say is true. We aren't a party to any deal, and any deal is solely between you and the other person.

3. Your account

  • Give us accurate information and keep it up to date.
  • Keep your password and any API tokens secret. You're responsible for everything done through your account, including anything done by an AI assistant or other software you connect with a token.
  • Tell us right away at info@needtofind.app if you think someone else is using your account.
  • One person, one account. Don't sell, share, or transfer your account or tokens.

4. Your content

You keep ownership of what you post: your ads, photos, responses, and messages ("your content"). To run the Service, you give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce (including resizing and re-encoding photos), display, and deliver your content, including showing your public ads to visitors and letting search engines index them. This license ends when you delete the content or your account, except that copies already delivered to other people (such as an email, or a response another member has received) may stay with them, and copies may remain in backups for a limited time.

You promise that you own or have the right to post your content, that it's accurate, that it doesn't break the law or anyone's rights, and that your photos don't show other people's private information.

5. Rules

You may not use the Service to:

  • Ask for, offer, or arrange anything illegal, or anything that's illegal to sell or possess, including stolen or counterfeit goods, recalled or unsafe items, firearms, ammunition, explosives, illegal drugs and controlled substances, protected wildlife, and hazardous materials.
  • Post adult sexual content or offer sexual services.
  • Scam, defraud, mislead, or impersonate anyone, or pressure people to pay in ways that are hard to reverse or trace.
  • Harass, threaten, discriminate against, or spread hatred toward anyone.
  • Spam: repeated or duplicate ads, mass or unsolicited messages, or unrelated promotion.
  • Share someone else's personal information without their permission.
  • Scrape or copy the site, or use automation to access it, except through our official AI-assistant connection using your own token. Don't try to get around limits, probe or attack our security, upload malware, or interfere with how the Service works.
  • File false or abusive reports.

6. Moderation and enforcement

Members can report ads, and our moderators review reports. We aren't required to monitor the Service, but we may remove or hide content, close ads, limit features, or suspend or end accounts when we think these Terms have been broken or someone needs protecting, sometimes without notice. When we remove one of your ads we'll normally email you the reason. If you think we got it wrong, write to info@needtofind.app and we'll take another look.

7. Deals between members

You are responsible for deciding whether to deal with someone and for how you do it. Check that an item is what it's said to be, be careful with payments and meetings, and read the safety tips in our FAQ. We don't guarantee the quality, safety, legality, or existence of anything, or the identity, honesty, or reliability of any member. Any dispute is between you and the other person.

8. AI assistants and API access

You can connect AI assistants that support MCP to your account using a token you create. Anything an assistant does with your token counts as done by you. We may set limits on how often the connection can be used, and may suspend tokens or accounts that abuse it. AI assistants and their providers are separate from us and have their own terms and privacy practices; we aren't responsible for what they do with information you give them or ask them to fetch.

9. Fees and changes to the Service

NeedToFind is currently free to use. We may add optional paid features in the future. If we do, we'll show the price clearly before you're charged, and we won't charge you for anything you haven't agreed to. We may also show notices about our other products or ask for optional support. We may change, add, or remove features at any time.

The Service may link to other websites and services. We don't control them and aren't responsible for them.

11. Our property

The NeedToFind name, logo, software, and design belong to us or our licensors. You may use the Service for its intended purpose, but you may not copy, sell, or misuse our property.

If you believe something on the Service infringes your copyright, email info@needtofind.app with: what work you own; where the material appears (the page address); your name and contact details; a statement that you believe in good faith that the use isn't authorized; and a statement, made under penalty of perjury, that your information is accurate and that you're the owner or authorized to act for the owner. We may remove the material and end the accounts of repeat infringers.

13. No warranties

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be uninterrupted, secure, or error-free, or that you'll receive any responses or find what you're looking for.

14. Limits on our responsibility

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, or for anything that happens between members or with third parties. Our total liability for any claim relating to the Service is limited to the greater of US$50 or what you've paid us in the past 12 months. Some places don't allow certain limits, so parts of this section may not apply to you.

15. If your content or conduct causes a claim

You agree to cover our reasonable costs and losses from any claim by a third party that arises from your content, your breaking these Terms, or your breaking the law.

16. Ending your use

You can stop using the Service at any time, and you can delete your account from your profile page. We can suspend or end your access as described above. Sections that by their nature should continue after that (such as content licenses already delivered, disclaimers, limits on liability, and this section) will.

17. Changes to these Terms

We may update these Terms. If a change matters, we'll tell you by email or with a notice on the site, and we'll update the date at the top. Using the Service after a change means you accept it.

18. The rest

These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If a part is found unenforceable, the rest still applies. If we don't enforce something, that doesn't mean we give up the right to. We may transfer these Terms in connection with a sale or reorganization of the Service; you may not transfer yours. These Terms are governed by United States law and the law of the state where Gray Penguin Development is based, without regard to conflict-of-law rules.
